Home Market · Business At My AddressThese Terms of Service (“Terms”) govern your use of 34m4.com and every shop hosted on it (for example name.34m4.com) (together, the “Platform”). 34M4 Home Market (“34M4”) is a trade name of Myanmar Gazette Inc., a California corporation located in Reseda (Los Angeles), California (“34M4”, “we”, “us”). By using the Platform you agree to these Terms. If you do not agree, do not use the Platform.
1. What 34M4 is
34M4 provides online shop software that lets independent home-based sellers (“Sellers”) offer home-cooked food, new and pre-loved items, services and event tickets to customers (“Buyers”). Each shop is run by its Seller. The Seller — not 34M4 — is the seller of record for everything sold in that shop and is responsible for the products, services and events offered. 34M4 does not cook, make, inspect, store, deliver or guarantee any item, service or event. 34M4 is not a delivery service, and it does not hold Buyers’ card payments: they go directly to the Seller’s own Stripe account. 34M4 only provides the shop software and receives a platform fee.
2. Accounts
- You must be at least 18 years old to open a shop or place an order.
- Keep your login details safe. You are responsible for activity on your account.
- Give accurate information and keep it up to date.
3. Sellers’ responsibilities
If you open a shop, you agree that you will:
- Food: sell home-cooked food only after you hold a valid Microenterprise Home Kitchen Operation (MEHKO) permit or other permit required by your local health department, display your permit number, and follow all of its rules — including meal limits, food safety, same-day preparation and delivery by you or your household (no third-party delivery apps).
- Services: hold any license or registration your service needs (for example a city business license; childcare in your own home for other families requires a California Family Child Care license).
- Events: hold the event as described, follow venue and local rules, and refund ticket buyers if the event is cancelled.
- Taxes: obtain any required seller’s permit (for example from the California Department of Tax and Fee Administration) and collect and pay all taxes that apply to your sales.
- Describe your items honestly, list allergens for food, honor your posted prices, pickup times and policies, and treat Buyers respectfully.
- Not sell prohibited items: alcohol, cannabis, tobacco or vaping products, medicines or supplements making health claims, weapons, recalled, counterfeit or stolen goods, live animals, adult content, or anything illegal.
- Handle Buyers’ personal information only to fulfill their orders and in line with our Privacy Policy and applicable law.
34M4 may limit, hide or remove listings, reviews or shops, or suspend accounts, that break these Terms or the law, or that put Buyers at risk.
4. Buyers
- Your order is a contract between you and the Seller. Read the item description and allergen information before ordering, and tell the Seller about allergies.
- Pick up your order at the time and place the Seller lists, or as agreed for a service or event.
- Questions, changes and refunds are handled by the Seller first — see our Refund & Cancellation Policy.
5. Payments and fees
- Card payments are processed by Stripe, Inc. and paid directly to the Seller’s own Stripe account. By paying by card you also agree to Stripe’s terms. 34M4 never sees or stores full card numbers.
- Cash or check is paid in person to the Seller; 34M4 is not involved in those payments.
- Coupons are issued by each Seller, are valid only in that Seller’s shop, have no cash value and may expire.
- Seller fees: opening a shop is free. On card orders, the Seller pays Stripe’s processing fee and a 34M4 platform fee (currently 2% of the order total, or 1% for event tickets), deducted automatically. We will give Sellers at least 30 days’ notice before changing our fees.
6. Reviews
Reviews must be honest, based on your own experience, and free of hate, harassment, personal information or advertising. Sellers may not review their own shop or pay for reviews. We may remove reviews that break these rules.
7. Content
You keep ownership of the photos, text and other content you post. You give 34M4 a non-exclusive, royalty-free license to host, display and promote that content on the Platform and in our marketing of the Platform. Only post content you have the right to use.
8. Disclaimers
The Platform is provided “as is” and “as available”. To the fullest extent allowed by law, 34M4 disclaims all warranties, express or implied. 34M4 is not responsible for the quality, safety, legality or delivery of any item, service or event sold by a Seller, including food allergies or illness, or for Sellers’ compliance with permits, licenses or taxes.
9. Limitation of liability
To the fullest extent allowed by law, 34M4 will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits, arising from the Platform. Our total liability for any claim is limited to the greater of (a) the platform fees we received from you in the 12 months before the claim, or (b) US $100.
10. Indemnity
Sellers agree to defend and hold 34M4 harmless from claims arising from their items, services, events, listings, permits, licenses, taxes, or breach of these Terms or the law.
11. Ending your account
You may close your account at any time by contacting us. We may suspend or close accounts that break these Terms. Sections that by their nature should survive (for example 8–12) continue after your account ends.
12. Governing law and disputes
These Terms are governed by the laws of the State of California. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California, unless the law requires otherwise. Please contact us first — most problems can be solved quickly.
13. Changes
We may update these Terms. We will post the new version here with a new “Last updated” date, and tell Sellers about important changes by email. Continuing to use the Platform after a change means you accept it.
